Federal Judge Strikes Down Missouri Second Amendment Law

A federal judge recently sided with the Biden administration Department of Justice, challenging Missouri’s Second Amendment Preservation Act (SAPA). The decision marks a rare win for gun control proponents, striking down a state-level protection for the 2nd Amendment.

Missouri’s Second Amendment Preservation Act Struck Down

The DOJ claimed this particular law undermined federal drug and weapons investigators, reported The Epoch Times. The Missouri law called for heavy fines, rising up to $50,000, on police departments for infringing upon Missourians’ rights.

But U.S. District Court Judge Brian Wimes ruled the Missouri law “invalid, null, void and no effect,” reported The Epoch Times. The Obama appointee struck down a law originally signed into law in 2021 by Missouri Gov. Mike Parson.

Ignoring 2A Laws

“SAPA’s practical effects are counterintuitive to its stated purpose,” Wimes wrote, reported The Epoch Times. “While purporting to protect citizens, SAPA exposes citizens to greater harm by interfering with the Federal Government’s ability to enforce lawfully enacted firearms regulations designed by Congress for the purpose of protecting citizens within the limits of the Constitution.”

The DOJ field suit last year, attacking the Missouri law as one that undermined their ability to conduct operations.

“The United States’ law enforcement operations have been affected through withdrawals from and/or limitations on cooperation in joint federal-state task forces, restrictions on sharing information, confusion about the validity of federal law in light of SAPA, and discrimination against federal employees and those deputized for federal law enforcement who lawfully enforce federal law,” court documents claimed, reported The Epoch Times.

Predictably, the smoking gun, as it were, came from an ATF agent. An agent in charge, Kansas City Field Division, ATF, claimed a dozen state and local offers withdrew from participating in ATF task forces, in part, due to the law, reported The Epoch Times.

It appears the ATF strikes again. We didn’t realize participating in task forces, seemingly a critical component of an agent’s job, was voluntary? As in, agents can just bow out because they don’t want to adhere to state laws? But what do we know…

Regardless, the judgement becomes one of the first losses after a wave of Sanctuary proclamations and greater protections across the U.S. Clearly, most Americans believe in protecting the 2nd Amendment. But the Biden-Harris administration believes on dismantling it at every level.
